Na ovaj praktičan način smo prenijeli stajalište španjolskog nadzornog tijela za zaštitu osobnih podataka.

Pri tom je naglašeno da prema članku 4. stavku 1. GDPR-a, fotografija osobe predstavlja osobni podatak jer odražava njena razlikovna obilježja, poput visine ili drugih fizičkih osobina, koja pomažu povezivanju s konkretnim pojedincem.

Štoviše, fotografija može informirati o dobi, spolu ili etničkoj pripadnosti, što olakšava identifikaciju osobe.

To što se na fotografiji ne vidi lice konkretne osobe, ne znači da se ta osoba ne može identificirati drugim detaljima s fotografije, barem konturom tijela ili nekom specifičnom karakteristikom fizičkog izgleda osobe.

Naime, definicija osobnog podatka iz GDPR-a kaže da tu spadaju svi podaci koji se odnose na pojedinca koji se može identificirati izravno ili neizravno, osobito uz pomoć identifikatora kao što su ime, identifikacijski broj, podaci o lokaciji, mrežni identifikator ili uz pomoć jednog ili više čimbenika svojstvenih za fizički, fiziološki, genetski, mentalni, ekonomski, kulturni ili socijalni identitet tog pojedinca.

Na primjer, na fotografiji djece svaki će roditelj prepoznati svoje dijete makar sva djeca bila fotografirana s leđa i s daljine.

Kod snimki video nadzora, gdje su u pravilu snimke lica manje precizne, pojedinac se ponekad može identificirati po specifičnom hodu ili kretnjama, pogrbljenosti i sl.

PRONAĐENI POSMRTNI OSTACI HEROJA HOS-a JEAN-MICHELA NICOLIERA

Na Ovčari kod Vukovara 25. rujna provedena je posljednja ekshumacija posmrtnih ostataka u blizini Spomen-doma, pri čemu su pronađena tri tijela muškaraca mlađe životne dobi. Prema prvim informacijama, riječ je o posmrtnim ostacima trojice vukovarskih branitelja – francuskog dragovoljca Jeana-Michela Nicoliera, zapovjednika Damjana Samardžića i njegova posinka Zorislava Gašpara-Gaše.

Jean-Michel Nicolier, rođen 1. srpnja 1966. u francuskom Vesoulu, u srpnju 1991. godine, unatoč molbama svoje majke, odlučio je doći u Hrvatsku i pridružiti se obrani zemlje. Najprije se priključio Hrvatskim obrambenim snagama kod Karlovca, a potom s dragovoljcima HOS-a otišao u Vukovar, gdje je sudjelovao u obrani grada od velikosrpske agresije.

Na vukovarskom Sajmištu ranjen je 9. studenoga 1991., a nakon pada grada, 18. studenoga, odveden je iz bolnice na Ovčaru. Tamo je, prema svjedočenju preživjelog Dragutina Berghofera, brutalno mučen i premlaćivan prije nego što je polumrtav izvučen iz hangara i pogubljen u noći na 21. studenoga. U trenutku smrti imao je samo 48 kilograma.

Prema pisanju tjednika Express, Udruga “Dr. Ante Starčević” iz Tovarnika godinama je tvrdila da je Nicoliera ubio Spasoje Petković, zvani Štuka, koji mu je, nakon što ga je izveo iz hangara, ispalio metak u potiljak i iz džepa uzeo 20 francuskih franaka. Kako je Večernji list pisao, Petković je kasnije dobio status zaštićenog svjedoka pred Specijalnim sudom za ratne zločine u Beogradu, gdje je svjedočio protiv drugih zločinaca i priznao niz ubojstava, uključujući i ono nad francuskim dragovoljcem.

U svom iskazu detaljno je opisao kako su zarobljeni Hrvati autobusima dovoženi pred hangare na Ovčari, gdje su ih tukli u špaliru i potom, pred iskopanom rupom, strijeljali. Među 260 ubijenih bio je i Jean-Michel Nicolier, čiji posmrtni ostaci do danas nisu bili pronađeni – sve do ove posljednje ekshumacije. Usprkos priznanju, zahvaljujući statusu pokajnika, Petković Štuka nikada nije kazneno odgovarao za svoje zločine.

Jean-Michel je nekoliko dana prije smrti dao izjavu za francusku televiziju, koja je postala simbol njegove žrtve: „Više puta su mi predložili da odem, ali ja sam ostao. Došao sam kao dragovoljac. Vukovar je moj izbor, i u dobru i u zlu.”

Njegova majka Lyliane Fournier godinama je tragala za njegovim posmrtnim ostacima, a svome sinu posvetila je potresno pismo u kojem je napisala: „Dio mog bića otišao je s tobom. Susrest ćemo se jednog dana, ako Bog da.”

Za svoju hrabrost i žrtvu, Jean-Michel Nicolier posthumno je odlikovan Redom Nikole Šubića Zrinskog, koji je u ime Republike Hrvatske primila njegova majka.

Pronalaskom njegovih ostataka zatvoren je jedno od najpotresnijih poglavlja vukovarske tragedije. Jean-Michel Nicolier, francuski dragovoljac koji je umro kao Hrvat, ostat će vječni simbol ljudske hrabrosti, časti i žrtve za slobodu.
