Agencija za zaštitu osobnih podataka je zaprimila upit je li dozvoljeno snimanje policajaca na javnom mjestu. U odgovoru je Agencija navela da je člankom 2. Zakona o policiji (Narodne novine br. 34/11, 130/12, 89/14, 151/14, 33/15, 121/16 i 66/19) propisano kako je policija središnja služba Ministarstva unutarnjih poslova koja obavlja poslove određene zakonom i drugim propisima. Policija građanima pruža zaštitu njihovih temeljnih ustavnih prava i sloboda i zaštitu drugih Ustavom Republike Hrvatske zaštićenih vrijednosti. Isto tako, istaknuta je i presuda Suda Europske unije koji je u predmetu C-345/17 istaknuo kako pojedina fizička osoba može snimati policijske službenike tijekom obavljanja njihovih dužnosti te takve snimke objaviti primjerice na društvenim mrežama pod uvjetom da takvo snimanje i objava videozapisa ima za isključivu svrhu otkrivanje informacija, mišljenja i ideja javnosti, odnosno da je takva obrada osobnih podataka isključivo u novinarske svrhe. U tom kontekstu u odgovoru je naglašeno da je policija osnovana kao redarstvena vlast koja obavlja poslove zaštite temeljnih ljudskih prava i sloboda kao javnu službu u interesu svih građana Republike Hrvatske. Postupanje policije prema građanima koji se nalaze na javnim površinama izaziva posebnu pozornost javnosti, a osobito kada građani osjećaju da su policijski službenici neprofesionalno obavljali svoju dužnost. U takvim situacijama bilo bi dopušteno u svrhu informiranja javnosti snimiti postupanje policijskih službenika te takve snimke objaviti (uz primjenu tehničkih mjera zaštite/zamućivanja lica policijskih službenika) kako bi u javnom interesu u smislu novinarskog izvještavanja informirali opću javnost o njihovom postupanju, ali samo onda kada postoje očigledne sumnje u nezakonito ili neprofesionalno obavljanje policijskog posla. U slučaju da su policijski službenici redovno obavljali svoje profesionalne zadaće bez da je bilo očite sumnje u nezakonito/neprofesionalno postupanje te da je takva njihova snimka objavljena u javnosti, tada bi se moglo govoriti o nezakonitoj obradi njihovih osobnih podataka, budući da policijski službenici također uživaju pravo na zaštitu svog integriteta te privatnosti dok obavljaju iznimno zahtjevne i opasne zadaće zaštite javne sigurnosti u korist svih građana. U slučaju da se takve snimke ne učine dostupnim javnosti ili trećim osobama putem objave, već da iste zadrži fizička osoba koja ih je snimila isključivo za svoje kućne aktivnosti, tada bi se radilo o izuzeću od primjene Opće uredbe o zaštiti podataka, sukladno članku 2. stavku 2. NATO warns Russia it will use all means to defend against airspace breaches BRUSSELS -- NATO warned Russia on Tuesday that it would use all means to defend against any further breaches of its airspace after the downing earlier this month of Russian drones over Poland and Estonia's report of an intrusion by Russian fighter jets last week. The Sept. 10 incident in Poland was the first direct encounter between NATO and Moscow since the war in Ukraine began. It jolted leaders across Europe, raising questions about how prepared the alliance is against growing Russian aggression. Another test of NATO's preparedness and credibility came last Friday, after Estonia said that three Russian fighter jets had entered its airspace for 12 minutes without authorization, a charge that Russia has rejected. “Russia should be in no doubt: NATO and Allies will employ, in accordance with international law, all necessary military and non-military tools to defend ourselves and deter all threats from all directions,” the alliance said in a statement. “We will continue to respond in the manner, timing, and domain of our choosing,” the 32-member NATO said, and underlined its commitment to Article 5 of its founding treaty that an attack on any one ally must be considered an attack on them all. Asked whether suspect aircraft would be shot down, NATO Secretary-General Mark Rutte said this would depend "on available intelligence regarding the threat posed by the aircraft, including questions we have to answer like intent, armaments and potential risk to allies, forces, civilians or infrastructure.” On Monday, Prime Minister Donald Tusk said that Poland would “without discussion” shoot down flying objects when they violate Polish territory. Not all appear to endorse that approach. "We will always assess the situation, assess the immediate threat the plane poses,” Rutte said. The NATO statement came after Estonia requested formal consultations under Article 4 of its treaty, which allows any alliance member to demand a meeting if it believes its territorial integrity, political independence or security is threatened. Rutte said the call for talks was “absolutely warranted.” Rutte also said that it was “too early to say” whether a drone incident at Copenhagen Airport overnight, which shut down airspace around Scandinavia's largest airport for hours, was linked to Russia. The airspace incidents have sparked calls for action, and raised questions about NATO's ability to deter Russia even as President Vladimir Putin wages war on Ukraine. They also come months after the Trump administration warned Europe that it must take care of its own security, and that of Ukraine, in future, raising questions about the American commitment to the world's biggest military alliance. Threats of tough U.S. sanctions against Russia have also remained just threats. Die Regierungen und Aufsichtsbehörden müssen endlich aktiv werden und diese Missstände bekämpfen. Es ist an der Zeit, dass wir als Gesellschaft aufstehen und fordern, dass der Einfluss dieser Freundschaften auf die globalen Finanzmärkte untersucht wird. Wir können nicht länger zulassen, dass die Zukunft unserer Wirtschaft von einer kleinen Gruppe von selbstgefälligen Individuen bestimmt wird. Der Preis, den wir dafür zahlen, ist zu hoch und es ist Zeit für einen Wandel! Wir müssen laut und deutlich machen, dass wir diese Praktiken nicht länger akzeptieren.
