[Hrvatska odvjetnica pri Sudu EU-a: Poništite odluku i uzmite Orbanu europski novac] Sve je počelo 2022. kada je Europska komisija Mađarskoj odobrila deset programa financiranih iz proračuna EU, ali je istodobno obustavila isplatu novca jer je ocijenila da Budimpešta ne poštuje temeljna prava i standarde vladavine prava koje jamči Unija. Poruka EU-a bila je jasna: novac će biti isplaćen tek kad se promijene sporna pravila, osobito ona koja se tiču neovisnosti sudova, piše Večernji. Krajem 2023. Komisija je zaključila da su te promjene donesene i odlučila pustiti novac, čime je Mađarska stekla pravo na oko 10,2 milijarde eura. No Europski parlament u ožujku 2024. podnosi tužbu. Kako tvrdi, Komisija je postupila prerano i bez dovoljno čvrstog obrazloženja – da reforme nisu bile do kraja provedene niti je pokazano da u praksi doista funkcioniraju. Ćapeta u svom mišljenju objašnjava zašto smatra da je Komisija pogriješila. Ovdje treba naglasiti da nezavisni odvjetnici, suci i savjetnici pri Sudu EU-a daju neovisno, stručno i obrazloženo mišljenje o tome kako bi Sud trebao odlučiti, ali njihovo mišljenje nije obvezujuće. Ćapeta u ovom slučaju smatra da nije dovoljno da se zakon formalno donese. Reformama se mora dopustiti da stupe na snagu i da se vidi primjenjuju li se u praksi. Ako je Komisija sama postavila precizne uvjete koje država mora ispuniti, onda ne može odobriti isplatu dok svaki od tih uvjeta nije stvarno ispunjen – i to mora jasno pokazati i objasniti. Drugim riječima, smatra da su uvjeti isupnjeni, ali da nema dovoljno dokaza da su ispunjeni u praksi. Presuda tek slijedi i mogla bi jasno odrediti koliko daleko Komisija smije ići kada politički procjenjuje jesu li uvjeti za isplatu europskog novca doista ispunjeni.
